Team Member Roster Choices and Your Rights

Bunnings members have been contacting the SDA about the Team Member Choices E-Form. The SDA has contacted Bunnings to clarify the situation. The following sets out the SDA’s agreed position with Bunnings in relation to roster choices in the proposed new EBA.

It should be noted that the new roster arrangements will only apply when the Fair Work Commission approves the proposed new Bunnings Warehouse & Smaller Format Stores Agreement 2019. We are hopeful that the Agreement will be approved early in 2020. The SDA will keep members informed of any developments.

 

What are my roster choices in the new Agreement?

The new Agreement contains the following roster choices for permanent team members:

Sunday work

If you work 3 out of 4 Sundays in a 4-week cycle, you must receive a full weekend off (clause 3.6(c)(i) of the new agreement). However, you can agree to work 4 Sundays in a 4-week cycle. You can revoke this agreement by providing 4 weeks’ notice (clause 3.6). Bunnings agrees with this position.

Consecutive Days Off

You must be rostered to have 2 consecutive days off each payroll week OR 3 consecutive days off in the rostered fortnight (clause 3.6(c)(ii)). However, you can agree to a roster where you don’t get 2 consecutive days off each payroll week or 3 consecutive days off each rostered fortnight. You can revoke this agreement by providing 4 weeks’ notice (clause 3.6). Bunnings agrees with this position.

Additional Hours

A part time team member can give Bunnings written consent to work additional hours at the ordinary time rate (with applicable penalties) (clause 3.8). This agreement can be revoked at any time in writing.  In the absence of a choice to work additional hours, any additional hours worked by a team member will be paid at overtime. Bunnings agrees with this position.

Where a team member agrees to work additional hours, they can choose to have the additional hours paid, or taken as Time Off In Lieu (TOIL) (clause 3.10).  A decision on how additional hours are compensated (either pay or TOIL) must be made by a team member in advance of an EBA Year and the decision applies for the entire EBA Year. So it is important that you choose the option you want, as you will be locked in for the rest the rest of this EBA Year, which finishes on the last pay cycle on or after 31 August 2020. You can change your decision for each EBA Year after that, prior to the EBA Year.

Making a decision by 1 December

The SDA has confirmed with Bunnings that all team members are still entitled to exercise a choice after 1 December. Choices entered in now are not final and can be changed, even after 1 December.

Bunnings have explained that team members are being asked to complete the Choices E-Form now to give them an understanding of how rosters could look when the new Agreement comes into operation. However, choices will not apply until the Fair Work Commission approves the new Agreement, and team members will be given another opportunity to complete the Choices E-Form when the new Agreement is approved and before it comes into operation.  

The SDA will keep Bunnings members updated about the progress of the approval of the new proposed Agreement, and any discussions with Bunnings about team member roster choices.
